Family members and other beneficiaries are often in disagreement over how the provisions of a will or trust should be interpreted or administered or how an estate and its assets should be managed. Litigation commences frequently against the executor or personal representative of an estate or against a trustee. We regularly handle claims and defend such will contests. Usually these matters involve the competency of the deceased, the authenticity of the operative legal documents, allegations of self-dealing, or allegations of undue influence. We have also represented interested persons where there is no will and disputes have arisen as to the appropriate administration of the estate.
